Unlawfully Carrying of a Weapon (UCW) Can be Expunged

As of September 1, 2021, Texans over the age of 21 can carry a handgun in public without license or training. House Bill 1927 eliminated the requirement for Texans to obtain a license to carry as long as they are not prohibited from possessing a gun by state or federal law. In 2018, more than 13,000 Texans were arrested for UCW or some other weapons charge.

If you have been convicted of UCW committed before September 1, 2021, you are eligible to receive an immediate expunction.

This new law entitles you to receive an expunction, meaning that there is no legitimate ground for the state to object. Also, because of the recent case law developed in the Texas Supreme Court, you will be entitled to an expunction for UCW even if you were charged for multiple offenses in the same arrest. For instance, if you were charged with DWI and UCW out of the same arrest, the UCW can be expunged from your record.
